Terms of delivery

Article 1. Definition

1. This agreement means::
a. General terms and conditions: these general terms and conditions in which the legal relationships and terms and conditions of the parties with regard to the delivery and distribution of the Musthef Bracelets.
b. MustHef Bracelets: the bracelets offered on www.musthef.nl.

Article 2. General

1. The agreement starts from the moment the buyer has paid the amount due and ends after the return date has expired.
2. These terms and conditions apply to every online agreement concluded by MustHef, insofar as the parties have not explicitly deviated from these terms and conditions in writing.
3. If one or more provisions of these terms and conditions are declared in whole or in part or are declared void or destroyed, the other terms and conditions will remain applicable.
The parties will consult on the provisions that replace the invalid and/or annulled provisions.
4. If there are contradictions between the agreement and the conditions, the provisions for those are included in the agreement.

Article 3. Payment and delivery

1. Payment by the buyer of the agreed price is made by one of our payment options.
2. After payment, an invoice will be sent to the specified email address of the buyer.
3. The buyer has fourteen days to return the Musthef Bracelet (s). MUSTHEF will pay the amount due to the buyer within thirty days. The return costs are for the account of the buyer.

Article 4. Dissolution and force majeure

1. If the buyer has well -founded reasons to assume that MustHef will not fulfill the agreement, the buyer is authorized to terminate the agreement.
2. The parties are authorized to terminate the Agreement if circumstances arise that cannot reasonably be expected for the agreement to be fulfilled.
3. In the event that MustHef does not comply with the delivered service, the payment will be refunded within 14 days to the indicated address, unless there is a force majeure situation.
4. There is a force majeure situation, apart from what is regulated in case law, all of outdoor causes (foreseen or not foreseen) on which Musthef cannot influence and where this cannot reasonably be expected from him.
5. If there is a force majeure situation, compliance with the agreement will be suspended. If Musthef cannot deliver within six weeks, the buyer is authorized to terminate the agreement.

Article 5. Liability

1. MustHef is not liable for damage, of whatever nature, that has arisen because the other party has provided incorrect or incomplete information.
2. MUSTHEF is not liable for improper use of the Musthef Bracelet (s) by the buyer.
3. Any damage suffered during the transport of the Musthef Bracelet (s) will be borne by MustHef. The buyer must contact MUSTHEF by e-mail with regard to the return.
4. If damage occurs, it is only due to MustHef if it is the result of intent and/or gross negligence.

Article 6. Applicable law and competent court

1. Dutch law applies to the agreement. The Vienna Sales Convention does not apply to the agreement and its implementation.
2. The parties first try to resolve the dispute. If this cannot reasonably be expected from the parties or the parties and among themselves do not come out, an appeal will be made to the court.
3. A dispute will be submitted to the competent court in 's-Hertogenbosch, insofar as compelling competence rules do not stand in the way of this choice.
